1. Introduction

Welcome to GoGoPiggy! These Terms of Service ("Terms") govern your access to and use of the GoGoPiggy mobile application and related services (collectively, the "Service") provided by True Factor Applications & Technology Solutions Pvt. Ltd. ("we," "us," or "our").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. By creating an account, downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Acceptance of Terms

By using the GoGoPiggy Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific features of the Service.

These Terms constitute a legally binding agreement between you and True Factor Applications & Technology Solutions Pvt. Ltd. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old to create a parent account. GoGoPiggy is designed for parent-supervised use with children. Children may not create accounts or use the Service without verifiable parental supervision and consent.

3.2 Account Creation

To use the Service, you must:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account with others
• Notify us immediately of any unauthorized access or security breach

3.3 Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

• Not create false identities or impersonate others
• Not create multiple accounts to circumvent restrictions
• Not allow anyone else to use your account
• Take reasonable steps to prevent unauthorized access

4. Use of the Service

4.1 Permitted Use

True Factor Applications & Technology Solutions Pvt. Ltd. grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms and applicable Indian laws.

4.2 Virtual Currency

Important clarifications about virtual currency in GoGoPiggy:

• Educational Tool: Virtual coins in GoGoPiggy are educational tools with no real monetary value
• Parental Responsibility: Parents decide how and when to redeem virtual currency for real-world rewards
• No Guarantee: Virtual currency does not create any obligation for True Factor Applications & Technology Solutions Pvt. Ltd. to provide any goods or services
• No Transfer: Virtual currency cannot be sold, traded, transferred outside the app, or exchanged for real money
• No Refund: Virtual currency has no cash value and is not refundable

4.3 Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations of India
• Infringe upon the rights of others
• Use the Service for any unlawful or unauthorized purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Transmit any viruses, malware, or malicious code
• Scrape, mine, or harvest data from the Service using automated means
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, circumvent, or disable any security features or copyright protections
• Use the Service to harm, threaten, or harass others
• Post or transmit inappropriate, offensive, or illegal content

5. Subscription and Payment Terms

5.1 Free Tier

GoGoPiggy offers a free tier with limited features. We reserve the right to modify, suspend, or discontinue the free tier at any time with reasonable notice.

5.2 Premium Subscription

Premium subscriptions may be offered with various pricing plans. Current pricing will be displayed in the app and on our website. Prices are subject to change with advance notice.

5.3 Billing and Payment

• Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date
• Payment Method: You authorize us to charge your payment method on file for all fees
• Price Changes: We may change subscription prices with 30 days' advance notice
• Taxes: Prices may not include applicable taxes (including GST), which will be added to your bill as required by Indian law
• Failed Payments: If payment fails, your Premium features may be suspended

5.4 Cancellation and Refunds

• Cancel Anytime: You may cancel your subscription at any time through app settings or your app store account
• Effective Date: Cancellations take effect at the end of the current billing period
• Access: You retain Premium access until the end of your paid period
• Refunds: Fees are generally non-refundable except as required by Indian consumer protection laws or at our sole discretion

5.5 App Store Purchases

If you purchase a subscription through the Apple App Store or Google Play Store, the purchase is subject to the app store's terms and conditions. All billing, refund, and subscription management must be handled through the respective app store.

6. Intellectual Property Rights

6.1 Our Rights

The Service, including all content, features, functionality, software, code, designs, graphics, logos, and trademarks, is owned by True Factor Applications & Technology Solutions Pvt. Ltd. and is protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

These Terms grant you a limited license to use the Service. You do not acquire any ownership rights to the Service or any content. All rights not expressly granted are reserved by True Factor Applications & Technology Solutions Pvt. Ltd.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without compensation or attribution.

7. User Content and Data

7.1 Your Data

You retain ownership of all data you input into the Service (tasks, transactions, goals, etc.). By using the Service, you grant us a limited license to use, store, and process your data solely to provide and improve the Service in accordance with our Privacy Policy.

7.2 Data Backup

While we implement backup procedures, you are responsible for maintaining your own backup copies of important data. We are not liable for any loss or corruption of your data except as required by Indian law.

7.3 Data Export

Premium users can export their transaction history. Upon account deletion, we may retain some data as required for legal compliance under Indian law or legitimate business purposes.

8. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the Information Technology Act, 2000 and related rules. By using the Service, you consent to our Privacy Policy.

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in app settings
• Contacting our support team at support@gogopiggy.com

9.2 Termination by Us

We may suspend or terminate your account with reasonable notice, or immediately without notice if you:

• Violate these Terms
• Engage in prohibited activities
• Provide false information
• Engage in fraudulent or illegal activities
• Harm or threaten to harm the Service or other users

9.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your account and data will be deleted according to our data retention policy
• You remain responsible for any fees incurred before termination
• Sections of these Terms that should survive termination will remain in effect

10. Disclaimers and Limitations of Liability

10.1 "AS IS" and "AS AVAILABLE"

TO THE EXTENT PERMITTED BY INDIAN LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

True Factor Applications & Technology Solutions Pvt. Ltd. does not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free from viruses or harmful components
• Results obtained from using the Service will be accurate or reliable

10.2 No Financial Advice

GoGoPiggy is an educational tool for teaching children about money management. It is not intended to provide financial, legal, or tax advice. You should consult with a qualified professional for specific financial guidance.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, TRUE FACTOR APPLICATIONS & TECHNOLOGY SOLUTIONS PVT. LTD. SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Damage arising from your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ₹5,000 (FIVE THOUSAND RUPEES), WHICHEVER IS GREATER.

Note: Nothing in these Terms shall limit or exclude our liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under Indian law.

10.4 Basis of the Bargain

You acknowledge that True Factor Applications & Technology Solutions Pvt. Ltd. has offered the Service, set its prices, and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, and that they form an essential basis of the bargain between you and us.

11. Indemnification

To the extent permitted by Indian law, you agree to indemnify, defend, and hold harmless True Factor Applications & Technology Solutions Pvt. Ltd., its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations of India

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Indian Contract Act, 1872, without regard to conflict of law provisions.

12.2 Informal Resolution

Before initiating any legal proceedings, you agree to contact us at support@gogopiggy.com and attempt to resolve the dispute informally. We'll do our best to resolve disputes amicably within 30 days of receiving your complaint.

12.3 Jurisdiction

Any disputes arising from or relating to these Terms, your use of the Service, or the collection, use, or disclosure of personal information shall be subject to the exclusive jurisdiction of the courts in [Your City], India.

You agree that any legal action or proceeding must be brought exclusively in the competent courts of India, and you consent to the personal jurisdiction of such courts.

13. Changes to Terms

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and True Factor Applications & Technology Solutions Pvt. Ltd. regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable under Indian law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction, provided that the assignee agrees to be bound by these Terms.

14.5 No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you and True Factor Applications & Technology Solutions Pvt. Ltd.

14.6 Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
